Chemicals to be phased out by EU
Six substances of very high concern will be banned
within 3 –5 years unless an authorisation has been
granted to individual companies for their use. These
substances are stated to be carcinogenic, toxic for
reproduction and persist in the environment or
accumulate in living organism.
Operators wishing to sell or use these substances will
need to demonstrate that the required safety measures
have been taken to adequately control the risks, or that
the benefits for the economy outweigh the risks.
Where alternative substances or techniques exist,
then a timetable for substitution will also have
to be submitted.
The chemicals are:
5-ter-butyl-2,4,6-trinito-m-xylene (musk xylene)
4,4’-diaminodiphenylmethane (MDA)
hexabromocyclododecane (HBCDD)
bis(2-ethylexyl) phthalate (DEHP)
benzyl butyl phthalate (BBP)
dibutyl phthalate (DBP)

New EU Rules for Notification
of Chemical Substances
The Health and Safety Executive is supporting the
Chemical Agency’s (ECHA) campaign to remind
companies that with effect from 1st December new
rules came into force on the classification, labelling,
packaging and notification of chemical substances.
Within one month, companies manufacturing or
importing a new chemical substance will need to
notify ECHA for their inclusion in the new
Classification and Labelling Inventory.
The new system will be phased in over a
five-year period for chemical substances from
10 December 2010 and for chemical mixtures from
1st June 2015.
The following will apply:
• Manufactured and imported substances (e.g. dyes
subject to REACH.
• Manufactured or imported substances which are
classified as hazardous irrespective of the quantity.
• Imported mixtures containing hazardous substances
irrespective of the quantity.
• Imported articles containing substances, which are
subject to REACH registration.
